Local developer Jennymar Corporation has received approval from ARPE for a 24 apartment project located at KM 1.1 on Highway 413 in Barrio Ensenada in Rincón in the coastal zone and within an estimated 500m of the Reserva Marina Tres Palmas. The project as proposed is high density and well beyond the existing zoning and the character of the neighborhood which is primarily single family homes on half acre lots. ARPE, the permitting agency, granted a permit and de-facto zoning change in violation of applicable laws and regulations.

UPDATES

June 8, 2005 – The PR Court of Appeals Aguadilla Branch ruled against Surfrider in its lawsuit against ARPE. To read the ruling, click here (6 MB Adobe .pdf file). Surfrider’s remaining course of action is to petition the Supreme Court of Puerto Rico.

March 21, 2005 – The Surfrider Foundation’s Rincón Chapter filed a lawsuit in the Aguadilla Branch of the Puerto Rico Appeals Court seeking the nullification of the ARPE approval of the 24 Unit Marina los Sueños Apartment Building in Barrio Ensenada, Rincón, PR.

The suit was filed after Surfrider’s Motion for Reconsideration was denied by ARPE on February 9, 2005. That request followed attempts by local residents and Surfrider members to stop ARPE from granting the variances during the public hearing process.

ARPE granted 4 variances (height, use, density, size) as part of its approval of the project.
