Local fisherman, citizens and the Rincón Chapter of the Surfrider Foundation are opposed to the construction of a condominium complex on the beach at the marina next to the Black Eagle. Permits for this project were granted illegally. Fortunately, as a result of a lawsuit brought forth by the citizen’s of Rincón this project has been sent back to the Planning Board.
Residents opposed to the construction of the Reina Del Mar condominium complex on the beach next to the old marina won their case in the Appellate Court when the court ruled that the project’s permits were granted illegally because the Planning Board failed to hold public hearings. The court also required a review the location of the start of the maritime zone – boundary of the public beach with the land. This project threatens to further privatize Rincón’s coastline and reduce public access to the beach. The area is also traditionally used by the local fishers.
This project emphasizes the need for more rigorous enforcement of existing rules and highlights Rincón’s need of a comprehensive land use plan (Plan de Orendación Territorial).
